California Penal Code 288

This section makes it a felony to commit a lewd act on a child for the purpose of sexually arousing the child. Penal code section 288 imposes a prison sentence of three (3), six (6), or eight (8) years in California State Prison.

California Penal Code 314

This section makes it a misdemeanor if a person knowingly exposes his or her genitals, female breasts, or buttocks in public to offender others. Penal code section 314 punishes the crime with up to 1 year in prison.

California Penal Code 261

This section makes it a crime for a person to have sex with a person they are not married to, and the person with whom they had sex was not able to properly consent to the sex because they have a mental illness or a physical disability that prevents them from properly doing so. For the prosecution to convict a person of lew conduct under California Penal Code Section 261, it must show that the person knew or should hae known of the mental or physical condition of the person they had sex with.

California Penal Code 289(a)(1)

This section makes it a crime to use a verbal or physical threat to harm another person to make them have sex with you. To convict a person under Penal Code Section 289, the prosecution must show that the victim did not consent to the sex. Section 289(a)(1) is a felony offense that’s punishable with three (3), six (6), or eight (8) years in California State Prison.
